TERMS AND CONDITIONS OF SALE AND USE OF THE TRUE MEDIA SERVICE

(Effective from 1st January 2026)

 

TrueMedia ® services are designed and managed by CONTROLH SAS, with its registered office at 142 avenue de Rivoli 75001 Paris – Paris Trade and Companies Register (RCS). SIREN No. 941 858 706. SIRET No. 941 858 706 00026.

The Publication Director is Pierre MIGNAVAL.

CONTROLH SAS offers the user the right to use the web service and/or to download and use the TrueMedia ® mobile application.

The TrueMedia ® mobile application provides optimised and secure services for the electronic transfer and processing of various types of media, which are geolocated, time-stamped at various levels, and linked to the account holder.

These timestamps are validated by the issuance of a blockchain certificate and can be certified by a Judicial Officer affiliated with TrueMedia ®

To use the TrueMedia ® services, the user must register and accept these terms. Acceptance of these terms constitutes an agreement between the user and CONTROLH SAS for an indefinite period from the acceptance of these general terms and conditions of sale and use (hereinafter referred to as «GTC/GSU»).

Any user is deemed to have accepted these agreements simply by using the services.

These Terms and Conditions of Sale/Use define the contractual.

By connecting to TrueMedia ® services, the user accepts these rules without reservation.

TrueMedia ® services can be accessed via the website at https://www.truemedia.fr, hereinafter referred to as «the Site», and via the TrueMedia ® mobile application downloadable onto a smartphone.

TrueMedia ® reserves the right to amend these T&Cs, the mobile application and the website https://www.truemedia.fr at any time, as it deems necessary and appropriate.

Consequently, any user is deemed to have accepted these modifications as soon as they use the TrueMedia ® services.

 

 

 

I – DEFINITIONS

Here is the meaning of the terms below:

Blockchain: A distributed ledger technology that enables all its users – who are also holders – to record information in accordance with specific rules established by a computer protocol secured by cryptography.

User Any natural or legal person who accesses the website or mobile application and holds an account. The user may create user sub-accounts allowing third-party partners to use the services under their sole responsibility.

User sub-account: A sub-account opened by the user to enable third-party partners with whom they work (employees, subcontractors) to use the services. The user sub-account is opened, closed and operated under the user’s sole responsibility and is linked to the user’s account.

Service provider: The service provider is defined as the company CONTROLH SAS (designer and distributor of the service, which is the subject of these Terms and Conditions of Sale and Use, via its application: TrueMedia ®).

Internet access: service enabling users to access the internet network and its various services.

Login details: confidential and personal access codes enabling the user to log in to the Platform and authenticate themselves on the mobile Application.

Platform / Website: the website offering TrueMedia® services at https://www.trumedi.fr and via the mobile app, which allows users to access their secure, personal account using their login details.

Mobile application : the mobile application downloadable to a mobile device from a download platform and enabling users to access via their mobile device the TrueMedia ® services as defined in Article 3 of the GTC/GUC below.

Partner Judicial Officer: A public notary practising as a Commissioner of Justice in accordance with the laws and regulations applicable to their profession, who has entered into a partnership agreement with CONTROLH SAS.

Account / Customer Area: the application interface enabling a user of TRUE MEDIA © services to access the features described in these Terms and Conditions of Sale/Terms of Use.

Content : any text, software, script, graphic, photograph, sound, music, video, PowerPoint presentation, audiovisual combination, whether protected by intellectual property rights or not.

 

Identity document: refers to all documents required to establish the right to use TrueMedia® services, such as a mobile phone number, an email address, a copy of an identity card or passport, or a residence permit for the legal representative.

This could also be a copy of an extract from the Kbis register or an EDF utility bill, or a company telephone bill; this list is by no means exhaustive.

 

 

II – ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE/TERMS OF USE

Browsing or using the mobile application and website in any way constitutes full and unreserved acceptance of these general terms and conditions of sale/use.

 

 

III – TRUEMEDIA SERVICES

TrueMedia ® offers a photo, video and even audio certification solution using the Tezos blockchain.

TrueMedia ® enables anyone who uses it to:

To certify one's recordings. To share them with a third party. To publish them on professional platforms. To protect one's copyright if the recording happens to be broadcast on any medium. Optionally, to deposit the recording in the digital safe of a judicial officer.

The data is kept for a period of 12 months from the user's registration date.

 

 

A/ PROVISION OF AN APPLICATION

TrueMedia ® is a web service. For practical reasons, it can also be used via a mobile app.

This one can be used and/or downloaded via the Internet, from a computer, a smartphone or a tablet capable of capturing photographs, videos or audio.

Throughout the process, the TrueMedia ® application certifies the integrity of the recordings. These are geo-localised, time-stamped and certified using blockchain technology, thereby guaranteeing the authenticity and immutability of all collected information. It is not possible to modify or tamper with the entry of documents, data and photographs once they have been saved in the application, which offers an additional guarantee of integrity and transparency.

The recordings can be shared, published on specialised platforms or (optionally) deposited in the digital vault of a Judicial Officer, who can draw up a report on the deposit of the items at any time.

 

 

B/ PROVISION OF TECHNICAL INFORMATION

When anchoring the original file, a certain amount of data (metadata) is recorded, such as data relating to the author, timestamp, geolocation, device, etc. In addition to the original capture file, the author or platform manager may add metadata or captions to enhance the quality of the capture's description. Under no circumstances will these additions be certified by the blockchain.

 

 

C/ COPYRIGHT

The author of the recordings will be able to claim copyright. At the time of anchoring, and therefore permanently, the author's contact details will be certified.

 

 

IV – YOU CHECKINN SERVICES REGISTRATION PROCEDURE

To benefit from the services offered by TrueMedia ®, an individual must set up a free account, either via the website or through the mobile application.

The individual must be at least 18 years of age and have the legal capacity to subscribe to and use TrueMedia ® services in accordance with these terms and conditions.

He undertakes to provide accurate information, which he promises to update without delay in the event of any changes. He certifies that the information shared regarding his identity, date of birth, home address, occupation, mobile number and email address is true and correct. He also guarantees that the identity document whose number he provides upon registration is valid and personally belongs to him.

 

Access to the newly created account is protected by a username and password chosen by the individual when registering on the site. They are solely responsible for any use that might be made of their username and password, and the only person who can guarantee their confidentiality, as well as any use of their account, including any action from the sub-accounts associated with the main account.

These usernames and passwords are strictly personal and cannot be shared or transferred to third parties. A copy of these is sent to the individual by email upon completion of their registration.

If the information shared during registration is incorrect or incomplete, registration for the services and their use will be made impossible.

If the individual provides incorrect, false, outdated or incomplete information, CONTROLH SAS reserves the right to suspend or close their account and to refuse them access, in the future, to all or part of the Services.

By proceeding with the registration, the individual authorises CONTROLH SAS to electronically forward their identification documents on their behalf to an associated Judicial Officer (Commissaire de Justice), so that the latter may draw up, in their name, a record of deposit at their office.

 

V – ACCESS TO TRUEMEDIA® SERVICES

Access to the Services is strictly restricted to registered Users.

Users must personally ensure the installation of the IT and telecommunication resources necessary for accessing the services. They remain responsible for telecommunication costs when accessing the Internet and using the site.

The services are accessible 24 hours a day, 7 days a week for all Users, provided they have an active internet connection, whether via a 3G/4G/5G mobile network, Wi-Fi, or a wired connection such as ADSL or fibre optic.

CONTROLH SAS cannot be held liable for any malfunction of its services if the user encounters difficulties accessing the Internet via the means they have set up, given that the service operates through the transmission of data via the Internet between the access terminal supporting the mobile application or using the website.

CONTROLH SAS reserves the right, without prior notice or compensation, to temporarily or permanently close the site or access to one or more services in order to carry out updates, changes or modifications to operational methods, servers and hours of accessibility, without this list being exhaustive.

CONTROLH SAS reserves the right to make any modifications and improvements to the Site and the Services that it considers necessary or useful for the proper functioning of the Site and its Services.

Any request made via TRUE MEDIA © services does not imply direct referral to the Judicial Officer, who will only be engaged within the limits of this mandate conferred by the acceptance of these T&Cs and the service provision agreement concluded with CONTROLH SAS.

 

VI – USER OBLIGATIONS

VI-1 Users must comply with all applicable laws and regulations.

VI-2 Users undertake not to share illicit content, content contrary to public decency, or content that infringes the rights of third parties. They must respect intellectual property rights and the right to privacy regarding one's image.

VI-3 Users must enable geolocation and not tamper with the application or its content.

VI-4 They must refrain from disrupting other users' access or the proper functioning of the services.

VI-5 Users are responsible for the accuracy, quality, integrity and legality of content shared via TrueMedia ® services.

VI-6 They are liable for any direct or indirect damage resulting from content transmitted via TrueMedia ® services and any inaccurate or misleading information provided during registration.

VI-7 Users are responsible for the security of their account and must report any unauthorised use or attempted intrusion.

VI-8 CONTROLH SAS retains the Connection Logs to establish proof of actions or omissions related to the use of TrueMedia ® services.

VI-9 CONTROLH SAS and the partner Judicial Officer do not validate the legal information or content published via TrueMedia ® services. They are not liable for any legal or tax consequences arising from the use of this content.

VI-10 The information provided by the use of TrueMedia ® services must under no circumstances be considered as personalised legal advice. CONTROLH SAS declines all liability regarding the use of energy audit reports or certificates obtained through TrueMedia ® services.

 

 

VII – PERSONAL DATA

In accordance with the amended French Data Protection Act of 6 January 1978 («Loi Informatique et Libertés»), the User is informed that TrueMedia ® automatically processes their personal data when they log in, register and use the services.

TrueMedia ® is committed to ensuring the security and confidentiality of this data. It is stored on the servers of 121 SAS, a company specialising in IT hosting.

These data are used to make the services accessible to the User, as well as for statistical purposes, direct marketing and sending newsletters. They are neither disclosed to third parties nor analysed.

TrueMedia ® retains the User's data for the duration of the contract and for up to 30 days after the end of the contractual relationship. The User may retrieve their files, certificates and minutes during this period.

The User has the right to access, modify, rectify, erase and object to the processing of their personal data. To exercise these rights, they may contact True Media © by email at rgpd@controlh.fr or by post at CONTROLH SAS – TrueMedia ®, 142 Rue de Rivoli, 75001 Paris France.

TrueMedia ® has declared this data processing to the CNIL. User data will be retained for 30 days after unsubscribing or account closure, in accordance with legal obligations.

In the event of a complaint regarding the use of the services, TrueMedia ® may forward the User's personal information to the judicial authorities upon request.

 

 

VIII – PERSONAL DATA

 

CONTROLH SAS, publisher of the TrueMedia ® application and website, processes its users« personal data in accordance with the French Data Protection Act (»Loi Informatique et Libertés"). This data is collected when using the application and is secured and stored by 121 SAS, a French company.

They are used to make TrueMedia ® services accessible to users, as well as for statistical purposes, direct marketing and sending newsletters. The data is not passed on to third parties and users have the right to access, modify and delete their personal data by contacting ControlH SAS.

 

 

IX – LIABILITY AND SECURITY

CONTROLH SAS cannot guarantee the compatibility of TrueMedia ® Services with certain firewalls or pop-up blocker utilities.

The user acknowledges the risks associated with using the Internet and is responsible for the use of the information exchanged. CONTROLH SAS disclaims all liability in the event of the Services failing to operate due to unsuitable equipment, Internet service provider malfunctions, or other reasons beyond its control.

Continuous availability of the Services is not guaranteed. CONTROLH SAS implements security measures to protect data, but there is an inherent risk associated with using the Internet.

 

 

X – GOVERNING LAW AND JURISDICTION

These T&Cs are governed by French law, and any dispute relating to these conditions shall fall within the jurisdiction of the courts of Paris.

 

 

XI – NULLITY – WAIVER

If any clause of these Terms and Conditions is declared null and void, this shall not affect the validity of the other clauses. The failure of CONTROLH SAS to exercise its rights shall not constitute a waiver of enforcing them.

 

XII – PROTECTION OF USER DATA

CONTROLH SAS has declared the collection and processing of personal data to the CNIL. The data collected is used solely for the operation of the TrueMedia ® application.

Users have the right to access, modify and delete their personal data. Data is kept for a limited period and is neither sold nor exchanged.

The Data Protection Officer at CONTROLH SAS is Mr Pierre MIGNAVAL.

TrueMedia ® may use cookies, and the user agrees to this use.

 

A/ PROTECTION OF YOUR PERSONAL DATA

In accordance with the French Data Protection Act («Informatique et Libertés»), CONTROLH SAS collects and processes your personal data. This information is confidential and is used solely for the drawing up of certificates and judicial officer's deeds via the TrueMedia ® application.

 

B/ INTERNET BROWSING SECURITY

CONTROLH SAS implements security measures to protect your information. However, it is your responsibility to protect your password and to exercise caution when using the application. CONTROLH SAS will never ask you for your password by email.

 

C/ ONLINE PAYMENT SECURITY

Transactions carried out via TrueMedia ® are secured using the SystemPay® payment system. Your payment details are not saved.

 

D/ SOCIAL MEDIA

CONTROLH SAS is present on social media such as Facebook®, Twitter®, YouTube®, Instagram®, LinkedIn® and TikTok®. Please be vigilant and never disclose your password or other confidential information in response to fraudulent requests.

 

E/ AMENDMENT TO THE PRIVACY POLICY

CONTROLH SAS reserves the right to amend its privacy policy, and users will be notified accordingly.
